Terms of Service

1. Acceptance of Terms

By accessing or using Mane Match ("the Service"), operated by Mane Match ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to use this Service. By using Mane Match, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to:

• Post false, misleading, or fraudulent listing information.
• Misrepresent the condition, health, training, or history of any horse listed.
• Upload content that infringes on intellectual property rights of others.
• Upload obscene, defamatory, threatening, or otherwise objectionable content.
• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Use automated scripts, bots, or scrapers to access the Service without permission.
• Interfere with or disrupt the Service or servers connected to the Service.
• Harass, abuse, or harm other users of the Service.
• Collect or store personal data about other users without their consent.

5. Listings & Content

5.1 User-Generated Content

You retain ownership of content you submit to Mane Match (photos, videos, descriptions). By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with operating and promoting the Service.

5.2 Content Standards

• All listings must accurately represent the horse being offered for sale or trade.
• Photos and videos must depict the actual horse listed.
• Pricing information must be truthful and current.
• Sellers must have legal authority to sell or trade the horse being listed.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, at our sole discretion. Users may also submit takedown requests through our Takedown Notice page.

6. Transactions

Mane Match serves as a marketplace platform connecting buyers and sellers. We are not a party to any transaction between users. Specifically:

• We do not guarantee the quality, safety, legality, or accuracy of any listing.
• We do not guarantee that any transaction will be completed.
• Buyers and sellers are solely responsible for the terms and completion of their transactions.
• We strongly recommend that buyers inspect horses in person and obtain veterinary evaluations before purchasing.
• We are not responsible for any disputes between buyers and sellers.

7. Listing Upgrades & Payments

• Listing a horse on Mane Match is free. During our launch promotion (through December 31, 2026 UTC), Boost visibility upgrades are provided free of charge for eligible listings. Optional paid upgrades (including Spotlight and Advanced Seller Profile) may still be offered for purchase.
• Accounts created before January 1, 2027 (UTC) are designated Founding Members and receive Verified status for the lifetime of the account, free of charge. Founding status is non-transferable and may be revoked only in cases of Terms violations or account abuse.
• After the launch promotion ends, paid Boost and other premium features are available through our third-party payment processors (Stripe on the web; Apple In-App Purchase in the iOS app where applicable). Existing paid subscriptions continue under their original terms unless canceled.
• All payments are final and non-refundable unless otherwise required by law.
• We do not store your credit card information. All payment data is handled securely by Stripe or Apple.
• Premium features are provided on an "as-is" basis and may be modified at any time.

8. Intellectual Property

The Service, including its design, logos, trademarks, text, graphics, and software, is owned by Mane Match and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANE MATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Mane Match, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Genesee County, Michigan.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mane Match regarding your use of the Service and supersede any prior agreements.
